Why applications get refused

The fiancé(e) or proposed civil partner visa lets you come to the UK for 6 months to marry, or form a civil partnership with, someone who is British, Irish or settled here. You must meet the same relationship, financial, accommodation and English requirements as a spouse. After the ceremony you switch to a spouse or partner visa without leaving the UK.

Why applications
get refused.

The Home Office doesn't refund fees for refused applications. These are among the most common reasons Fiancé(e) Visa applications fail, and exactly what our former-judge review is designed to catch.

A refusal would cost you £2,064 in Home Office application fees, which aren't refunded. And you'd lose months starting again, with a refusal to declare on future applications.
  1. No clear plans to marry

Caseworkers want to see that the wedding is real and imminent: a venue booking, correspondence with the registrar or venue and a realistic date within 6 months of arrival.

  2. Relationship not shown to be genuine

Couples who have spent little time together, can't show they've met in person, or whose accounts of the relationship don't match are more likely to be refused.

  3. Not yet free to marry

If either of you is still legally married or in a civil partnership when you apply – for example because a divorce hasn't reached its final stage – the application will fail.

  4. Financial evidence problems

Missing payslips, statements that don't match, savings held for less than 6 months or relying on income that can't be counted are among the most common reasons for refusal.

  5. Applying on the wrong route

If you're already married you must apply as a spouse. If you only want to marry in the UK and then leave, a Marriage Visitor visa is the correct route.

  6. Missing English or accommodation evidence

An English test from an unapproved provider, or no clear evidence of where you'll live and that it won't be overcrowded, can sink an otherwise strong application.

Where AI chatbots go wrong on this routeMistakes AI tools commonly make on this route. Any one of them can mean a refusal, and a £2,064 application fee you won't get back.
  1. Applying the wrong money rulesThe financial test is the same as for a spouse visa: a combined income of £29,000 a year, or cash savings above £16,000 counted at a rate of 2.5 to 1 (£88,500 to rely on savings alone), held for 6 months. Because you apply from abroad, your own overseas salary doesn't count. Chatbots still quote the old £18,600, or add your overseas pay to the total.
  2. Planning the wedding without the legal timelineYou must marry within 6 months of arriving. You give notice together at the register office where one of you has lived for the past 7 days, at least 29 days before the ceremony, and up to 70 days if the Home Office investigates. AI rarely plans backwards from those dates, so couples pick a date that leaves no room if anything slips.
  3. Wedding plans a caseworker won't believeCaseworkers want proof that the wedding is real and imminent: a venue booking, correspondence with the registrar or venue, and a realistic date. A chatbot's generic list of photos and messages doesn't show that, and 'no clear plans to marry' is one of the most common fiancé(e) refusals.
  4. Applying before you're free to marryNeither of you can still be legally married or in a civil partnership on the day you apply. If a divorce hasn't reached its final stage, the application fails, however genuine your relationship is. AI tools rarely ask where a previous divorce has got to.
  5. Choosing the wrong routeIf you're already married, you must apply as a spouse. If you only want to marry in the UK and then leave, you need a Marriage Visitor visa. Marrying abroad first and applying straight for a spouse visa can save a second application and health surcharge. Chatbots answer the question you asked, not the one you should have asked.
  6. Saying you can work, and stopping at step oneYou can't work on a fiancé(e) visa. After the wedding you must switch to a spouse visa, with a £1,407 application fee and a £2,587.50 health surcharge per adult, and meet the financial requirement again. AI answers often say you can work, or stop at the first visa and leave you unprepared for the second.

  • Best Immigration Solicitors.

I would like to sincerely thank Mayfair Solicitors, especially Mr. Mohsin Uddin, for handling every stage of my immigration journey with exceptional professionalism and genuine care. From my very first application – the Spouse Visa – Mohsin Uddin tailored every detail with precision, ensuring nothing was ever missed. I had previously dealt with another solicitor, but the difference in service was remarkable. Mohsin was never too busy to answer my calls, respond to my emails, or reassure me when I was anxious. His communication and commitment gave me confidence at every step. Because of the trust and faith I developed in him, I also instructed Mohsin to manage my ILR (Indefinite Leave to Remain) application. Thanks to his guidance and meticulous attention to detail, my ILR was approved within three months. Mohsin then advised me to apply for Naturalisation without delay due to upcoming rule changes and rising passport fees. I followed his advice, and with his continued support, I received my British Passport in November 2025 — something I once feared might never happen. I was extremely worried when I started this process years ago, but Mohsin’s expertise, encouragement, and clear direction gave me the confidence to submit everything required by the Home Office without hesitation. If anyone is struggling with immigration matters or needs trustworthy legal representation, I wholeheartedly recommend Mayfair Solicitors. I am living proof of what the right solicitor can achieve.

  • Excellent and top quality service by Mayfair and John

John and Mayfair team had previously supported us in our spouse visa application 2 years back with a fantastic service. Therefore, we engaged again with John and his team, who have been very helpful and super supportive in assisting our spouse visa extension case. So, this is our second engagement with Mayfair and they are brilliant. Highly professional and specialized in what they do. We appreciate John and his team were always reachable and had addressed any queries/issues we raised to them ensuring we are at peace, which we felt very important and fantastic about them. We will engage with them in 2.5 years of time from now for my wife's ILR. God bless you John and team for your support and service.

Who it's for

You can apply if one statement from each group below describes you, and you meet all the eligibility requirements further down.

1
Your plansOne of these
  • You're engaged, and will marry in the UK within 6 months of arriving
  • You'll form a civil partnership in the UK within 6 months of arriving
2
Your partnerOne of these
  • Is a British or Irish citizen
  • Is settled in the UK, for example with indefinite leave to remain or settled status
  • Has refugee status or humanitarian protection in the UK
  • Has EU Settlement Scheme pre-settled status and started living in the UK before 1 January 2021
3
Where you're applying fromRequired
  • Outside the UK: fiancé(e) applications can't be made from inside the UK
02

Eligibility requirements

You'll need to meet every one of these. Each has its own evidence rules, and that's where applications most often go wrong.

  1. 01

    Your partner's status

Your partner must be a British or Irish citizen, be settled in the UK (for example with indefinite leave to remain), have pre-settled status having started living in the UK before 1 January 2021, or have refugee or humanitarian protection status. source

  2. 02

    Age

You and your partner must both be 18 or over on the date you apply. source

  3. 03

    A genuine relationship

You must have met in person, your relationship must be genuine and continuing, and you must intend to live together permanently in the UK. source

  4. 04

Plans to marry in the UK

You must be coming to the UK so that your marriage or civil partnership can take place here, within 6 months of your arrival. source

  5. 05

    Free to marry

Neither of you can be married to, or in a civil partnership with, anyone else on the date you apply, and any previous relationship must have permanently broken down. source

  6. 06

    Financial requirement

You usually need a combined gross income of at least £29,000 a year, cash savings, or a mix of the two – the same test as for a spouse visa. source

  7. 07

    Suitable accommodation

You must have adequate accommodation that you own or occupy exclusively, which won't be overcrowded and which you can live in without claiming public funds. source

  8. 08

    English language

You must pass an approved English test in speaking and listening at level A1 or above, hold a degree taught in English, or be exempt – for example as a national of a majority English-speaking country or if you're aged 65 or over. source

03

Financial requirement

The financial requirement is the same as for a spouse visa: a combined gross income of at least £29,000 a year, or cash savings above £16,000 to make up any shortfall. source

  • Savings above £16,000 are divided by 2.5 and counted towards the target. To rely on savings alone you need £88,500 (£16,000 + 2.5 × £29,000).
  • Savings must be held in cash, in your name, your partner's name or jointly, for at least 6 months before you apply.
  • Because you're applying from abroad, your own overseas salary doesn't count. Your partner's UK earnings, certain other income and savings held by either of you can.
  • If your partner has worked for their current employer for less than 6 months, they must also show they earned the required amount over the previous 12 months.
  • You'll need to meet the financial requirement again when you switch to a spouse visa after the wedding, so plan for it to continue.
  • If your partner receives certain disability or carer's benefits, you only need to show you can maintain and accommodate yourselves adequately without public funds.
04

English language

You need English speaking and listening at CEFR level A1 or above from an approved Secure English Language Test (SELT) provider, or a degree taught in English (an overseas degree needs confirmation from Ecctis). If you meet this with an A1 test, you won't need a new test when you switch to a spouse visa, but you'll need at least A2 when you later extend as a partner. You're exempt if you're a national of a listed majority English-speaking country, aged 65 or over, or have a condition that prevents you meeting the requirement. source

10

Duration & settlement

How long it lasts

Up to 6 months. You cannot work during this time, and you must switch to a spouse or partner visa once you've married.

Route to settlement

Time on a fiancé(e) visa does not count towards settlement. Once you switch to a spouse or partner visa, you can usually apply for indefinite leave to remain after 5 continuous years as a partner.

11

Frequently asked questions

Can I work on a fiancé(e) visa?

No. You cannot work while you're in the UK as a fiancé(e) or proposed civil partner. Once you've married and switched to a spouse or partner visa, you can work and study.

Should we apply for a fiancé(e) visa or a spouse visa?

If you can marry outside the UK first, applying straight for a spouse visa means one application instead of two, saving the second fee and healthcare surcharge. The fiancé(e) visa suits couples who want to marry in the UK.

What is the difference between a fiancé(e) visa and a Marriage Visitor visa?

A Marriage Visitor visa lets you marry in the UK, but you must leave afterwards and cannot switch to another visa. A fiancé(e) visa is for couples who plan to live in the UK together after the wedding.

Do I pay the immigration health surcharge?

Not for the fiancé(e) visa itself, because it's applied for outside the UK and lasts 6 months. You will pay it when you switch to a spouse visa – £2,587.50 per adult for a 2 year 6 month grant.

What if our wedding is delayed?

If you don't marry within your 6 months, you may be able to extend your stay as a fiancé(e) if there's a good reason for the delay and evidence that the wedding will take place within the next 6 months. Get advice before your visa runs out.

How soon can we give notice of marriage?

Once you've arrived. You give notice together at the register office for the district where at least one of you has lived for the past 7 days, at least 29 days before the ceremony. If the Home Office investigates, the wait can be up to 70 days, so leave room within your 6 months.

Will I need another English test when I switch to a spouse visa?

Not if you met the requirement for your fiancé(e) visa with an approved test. You'll need at least A2 later, when you extend after 2 years and 6 months as a partner.

12

How we help with your Fiancé(e) application

  1. 01

Advise whether a fiancé(e) visa, spouse visa or Marriage Visitor visa best fits your plans and budget.

  2. 02

Check that the financial requirement is met now and will still be met when you switch after the wedding.

  3. 03

Prepare relationship and wedding-plan evidence that answers the questions caseworkers are likely to ask.

  4. 04

Plan your timeline around processing times, the notice of marriage period and your 6-month visa.

  5. 05

Handle your switch to a spouse visa after the ceremony so there's no gap in your permission to stay.
